Harvey Weinstein asks for $2 million bail while he appeals his rape conviction claiming his Hollywood films 'shined a spotlight' on social issues, including sexual assault - as he faces fresh sex crimes charges in LA
Harvey Weinstein has asked to be released on $2million bail pending the outcome of an appeal of his New York rape conviction, claiming his Hollywood films 'shined a spotlight' on social issues including sexual assault.
Weinstein's lawyers submitted a bail application to a higher court on Friday arguing his work has helped tackle 'human struggles' including racial injustice, sexual assault and disability.
The court documents also cited his philanthropy work and ailing health to argue the 68-year-old should be freed while he appeals his conviction.
In March, Weinstein was sentenced to 23 years in prison for rape and sexual assault in his landmark #MeToo trial and is being held in Wende Correctional Facility inAlden, New York.
He is now also facing 11 charges of sexual assault involving five women in California, after the Los Angeles District Attorney announced six new charges this month.
Weinstein claims he should be released on bail because through his film career he 'shined a spotlight on a myriad of human struggles' including 'sexual assault on campus [in] 'The Hunting Ground,'' according to the bail application written by his attorney Barry Kamins, reported Page Six.
The disgraced media mogul has also raisedawareness of racial injustice in the likes of 'The Butler,' Nelson Mandela's 'Long Walk to Freedom' and 'Fruitvale Station' and 'engendered empathy for those who are afflicted by disabilities that society has stigmatized and for those who are victimized by injustice,' the court papers say.

The rapist's lawyers also point to his charity work calling him a 'force in philanthropy' who has raised millions of dollars for various causes.
Weinstein's legal team also cite his ill health in the application, saying heis suffering 'serious medical conditions' and is taking 20 different medications for various ailments.
Weinstein, who used a walker to enter the courtroom for his Manhattan trial earlier this year, is now confined to a wheelchair and is losing vision in both eyes because of his diabetes, according to his lawyers.
He also has an enlarged aorta and prostate, the papers say.
The disgraced media mogul was hospitalized with chest pains just hours after the judge handed down his sentence in his landmark trial.
He then tested positive for coronavirus while behind bars back in March.
He was placed in isolation for 23 days and reportedly recovered without showing serious symptoms.
His lawyers claim the 68-year-old is at increased risk of contracting the virus again in prison.
Kamins writes that the Los Angeles County Superior Court has granted Weinstein's release on $5 million bail for the charges he faces in California.
Weinstein will post the $5 million bond in LA and can then post $2 million in New York to be released from prison, he writes.
The New York bail application was submitted as Weinstein's lawyers are preparing to file an appealwith the Appellate Division First Department to overturn his conviction for rape and sexual assault.
His appeal is based on the argument that the judge,Justice James Burke, allowed evidence of other alleged crimes for which Weinstein wasn't charged to be heard in court and that a members of the juryhad repeatedly lied to the court.
'Mr. Weinstein has meritorious issues that he will raise on appeal that are likely to result in a reversal of his conviction,' the application states.
Weinstein was found guiltyon February 24 of two out of five criminal charges: one count of criminal sexual assault in the first degree and one count of rape in the third degree.
He was sentenced the next month to23 years in prison - 20 years for forcibly performing oral sex on production assistant Mimi Haleyi in 2006 and three years for third degree rape for the attack on Jessica Mann in 2013.

The Los Angeles District Attorney announced six counts of forcible sexual assault in Los Angeles had been brought against him on October 2.
The charges,which include three felony counts each of forcible rape and forcible oral copulation, involve two victims and stem from incidents that occurred more than a decade ago in an unnamed Beverly Hills hotel.
These fresh charges are on top of charges filed in LA in January with raping one woman and sexually assaulting another in two separate incidents in 2013.
In April, authorities then added another charge from an alleged incident at a Beverly Hills hotel in May 2010.
In total, Weinstein faces four counts of forcible rape, four counts of forcible oral copulation, two counts of sexual battery by restraint, and one count of sexual penetration by use of force.
All of the alleged assaults took place between 2004 and 2013 in the Los Angeles area and involve five victims.
Weinstein is scheduled to appear for an extradition hearing on December 11 for the LA charges.
